These Terms apply when you purchase products from Soller Direct through our website.
2. Scope of these Terms
These Terms govern the supply of products ordered from Soller Direct.
They should be read together with any product information, quotation, order confirmation and the customer-information pages available on our website, including our Delivery Information, Returns & Cancellations, Warranty and Privacy Policy.
If a specific quotation or order confirmation contains terms that expressly differ from these Terms, the specific wording agreed for that order will apply to the extent of that difference.
Nothing in these Terms affects any rights you have under applicable UK consumer law.
3. Products and product information
Soller Direct supplies specialist awnings and architectural products.
Some products are supplied in standard sizes or specifications. Others may be manufactured, cut, configured or otherwise produced specifically for your order.
We take reasonable care to describe and display our products accurately. However, images, colours, finishes and proportions shown on screens are illustrative and may appear differently depending on your device, display settings, lighting conditions and the nature of the material.
Product dimensions, technical requirements and compatibility remain particularly important for specialist and configurable products. Please check all dimensions, colours, specifications and selected options carefully before placing your order.
If you are unsure whether a product or configuration is suitable, please contact us before ordering.
4. Orders and contract formation
Placing an order through our website is an offer by you to purchase the selected products.
Your order is not necessarily accepted simply because payment has been authorised or an automated acknowledgement has been sent.
A binding contract is formed when we accept your order, normally by issuing an order confirmation or otherwise confirming that the order has been accepted.
We may decline or cancel an order before acceptance where, for example:
- a product is unavailable;
- there is an obvious pricing or description error;
- we cannot deliver to the supplied address using suitable arrangements;
- payment cannot be authorised;
- additional information reasonably required to process a specialist or configured order has not been provided; or
- we reasonably believe the order cannot be fulfilled as placed.
If we have taken payment for an order that we do not accept, the relevant amount will be refunded.
5. Prices and VAT
Prices are shown in pounds sterling unless stated otherwise.
Where VAT is applicable, prices displayed to consumers will include VAT unless clearly stated otherwise.
Delivery, specialist freight, survey, installation, commissioning or other services are not included unless they are expressly stated as included in the relevant product, checkout, quotation or order confirmation.
Where delivery can be calculated during checkout, the applicable charge will be shown before you complete your order.
Where specialist freight or individually arranged delivery is required, the cost and arrangements will be confirmed separately before dispatch.
6. Payment
Payment is processed through Shopify and the payment providers made available through our checkout.
Payment methods may include cards, Shop Pay, Apple Pay, Google Pay, Klarna or other methods where available.
The payment methods shown to you at checkout may vary and we do not guarantee that any particular payment method will always be available.
Where a third-party payment or finance provider is used, its own eligibility requirements and terms may also apply.
7. Product configuration and made-to-order goods
Some Soller Direct products may be manufactured, cut, finished or configured specifically to the measurements, colours, options or specification selected by you.
You are responsible for checking the information you provide and the configuration you approve before placing the order.
Where a product is genuinely made to your specifications or clearly personalised within the meaning of applicable consumer law, the usual statutory right to cancel a distance contract may not apply.
This exception does not apply merely because a product is specialist, valuable or normally ordered for a particular project.
Where a product is a standard product and does not fall within a statutory cancellation exemption, your applicable cancellation rights remain unaffected.

8. Delivery
Delivery arrangements vary according to the product, its dimensions, destination and freight requirements.
Any lead-time information given is an estimate unless we expressly agree otherwise.
Where delivery arrangements or charges require individual confirmation, we will communicate these before dispatch.
You are responsible for providing an accurate delivery address and suitable contact details.
You must also ensure that reasonable access is available for delivery of the goods, taking into account the size and nature of the product.

9. Inspection on delivery
Please inspect delivered goods promptly.
If there is visible transit damage, a missing item or another apparent delivery problem, please contact Soller Direct as soon as reasonably possible.
Where appropriate, retaining the goods, packaging and photographs of the condition in which the order arrived may assist us in investigating the issue.
Prompt notification helps us deal with freight and delivery issues efficiently, but nothing in this section removes or limits your statutory rights.
10. Cancellation and returns
Your cancellation and return rights depend on the nature of the goods and the circumstances of the order.
For eligible standard or non-bespoke goods, you may have statutory rights to cancel a distance contract and return the goods.
Different rules may apply to goods genuinely made to your specifications or clearly personalised.
Nothing in these Terms removes any statutory right you may have where goods are faulty, damaged, misdescribed or incorrectly supplied.
Please contact Soller Direct before returning any product so that suitable return arrangements can be confirmed.

11. Faulty or misdescribed goods
We are responsible for supplying goods that comply with applicable consumer law.
If goods are faulty, not of satisfactory quality, not fit for a purpose made known to us where the law requires this, or do not match their description, you may be entitled to statutory remedies.
These rights are separate from, and may be additional to, any manufacturer or commercial warranty.
Please contact us with your order details and information about the issue so that we can investigate and arrange the appropriate next step.
Nothing in these Terms limits your statutory rights.
12. Warranty
Products are covered by the applicable product or manufacturer warranty provided for that product.
Any specific warranty period or enhanced Soller Direct warranty will be stated in the relevant product documentation, quotation or order information.
We do not apply one universal warranty period to every product.
Warranty cover is subject to the terms applicable to the relevant product and may not cover matters such as accidental damage, misuse, unauthorised modification, inappropriate maintenance, normal wear and tear or external causes where the applicable warranty excludes them.

A commercial warranty is in addition to, and does not replace, your statutory consumer rights.
13. Professional survey, installation and other services
Professional survey, installation, commissioning and other site services are separate from standard online product supply unless expressly included in your order or quotation.
Purchasing a product online does not automatically include professional installation.
Where any such service is separately agreed, the scope, price and applicable service terms will be confirmed as part of the relevant quotation, order or agreement.
You should not assume that a product is suitable for a particular location, fixing method, structure or installation method unless that suitability has been expressly confirmed.
14. Ownership and risk
Risk in the goods passes to you in accordance with applicable law, normally when the goods come into your physical possession or the possession of a person you nominate to receive them.
Ownership of the goods passes to you once we have received payment in full, unless applicable law requires otherwise.
Nothing in this section overrides mandatory consumer rights.
15. Your responsibilities
You are responsible for:
- providing accurate contact, billing and delivery information;
- checking product dimensions, specification, colour and selected options before ordering;
- providing accurate measurements where you are ordering on the basis of measurements supplied by you;
- following applicable product, installation, operating and maintenance instructions; and
- contacting us before ordering if you are unsure about the suitability or configuration of a product.
Where we rely on information or measurements supplied by you, we are not responsible for a problem caused solely by that information being inaccurate, except where the law provides otherwise.
16. Website and product information
We aim to keep the information on our website accurate and up to date.
Minor changes may be made to products or specifications where necessary, provided those changes do not materially reduce the product’s functionality or quality and do not breach your legal rights.
We may correct obvious typographical, technical or pricing errors.
Nothing on our website should be treated as professional structural, architectural, electrical or installation advice unless we expressly state otherwise.
17. Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot legally be excluded or limited.
We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Where you are purchasing as a consumer, we do not exclude liability for your statutory rights.
We are not responsible for loss caused by inaccurate measurements, specifications or information supplied by you, where we have supplied the goods correctly in accordance with that information, except to the extent that applicable law provides otherwise.
18. Events outside our reasonable control
We are not responsible for delay or failure caused by circumstances outside our reasonable control.
These may include disruption affecting manufacturers, transport, freight, customs processes, supply chains, utilities, communications, severe weather, industrial action, government action or other events that we could not reasonably prevent.
If such an event materially affects your order, we will take reasonable steps to minimise the effect and keep you informed where appropriate.
Your statutory rights remain unaffected.
19. Personal information
We process personal information in accordance with our Privacy Policy.
Our online store is powered by Shopify, and personal and payment-related information may also be processed by Shopify and relevant payment or service providers as described in that policy.
20. Changes to these Terms
We may update these Terms from time to time to reflect changes in our business, products, website or legal requirements.
The Terms applying to your order will normally be those in force when your contract with us is formed, unless a later change is required by law or is expressly agreed with you.
21. Governing law and jurisdiction
These Terms are governed by the law of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory protections available to you under the law applicable to you.
Nothing in these Terms prevents you from bringing proceedings in a court where applicable consumer law gives you the right to do so.
